Phase Criteria

Sobriety Court consists of three phases. If you violate any term of your probation or any Sobriety Court condition, your phase may be extended. You will not earn time for days you are in jail or in violation of your probation. Significant or repeated violations may result in losing credit toward phase completion, and you may have to start over in your current phase. If you have any unexcused violation of any requirement in Phase 3, then you may start Phase 3 over. Therefore, if you complete the program with minimal or no violations, you will successfully graduate from Sobriety Court in approximately 12-18 months. Upon graduation, you will continue on probation with the Barry County Trial Court, 56-B District Court.

Phase requirements are listed below. Changes in requirements between phases are in bold for your convenience.

Attend Sobriety Court Review Hearings at least two times monthly, or as scheduled by the Court. In the event that the Judge is not available, you will meet with the Sobriety Court Team. Attend Sobriety Court Review Hearings at least one time per month as scheduled by the Court. Same as Phase 2.
Meet with  your Case Manager at least four times per month, either in the office or at your home as directed. You must allow the Program Coordinator, Case Manager, and/or Probation Officer into your home and allow him/her to search your home or property (car, cell phone, computer, jacket, purse, etc.) as directed.  Same as Phase 1. Meet with your Case Manager at least one time every other week, either in the office or at your home as directed. 
Report to your Probation Officer as directed. Same as Phase 1. Same as Phase 2. 
Submit to random drug/alcohol testing at least two times per week. You may also be placed on an alternate type of monitor (tether, SCRAM, etc.) as well. Submit to random drug/alcohol testing at least two times per week.  Submit to random drug/alcohol testing at least two times per week. 
Attend and/or successfully complete Substance Abuse or Mental Health treatment.
Attend and complete Relapse Prevention Group.
Attend and/or successfully complete Substance Abuse and/or mental health treatment.  Attend and complete MRT. Attend and/or successfully complete Substance Abuse and/or mental health treatment.  Attend and complete Relapse Prevention Group graduation sessions. 
Initiate the development of your Recovery and/or Relapse Prevention Plan. Same as Phase 1. Review your Recovery and/or Relapse Prevention Plan with your therapist and report your progress. 
Attend self-help groups (AA, NA, etc.) at least three times per week, or as ordered by the Court. Although we encourage you to attend as many sessions in one period as you feel you need, you are not allowed to stack your attendance one week to make up for a week you did not attend as required.  Attend self-help groups at least two times per week, or as ordered by the Court.  Attend self-help groups at least two times per week, or as ordered by the court. Additionally, you must attend and complete all graduation groups as directed.
Obtain a sponsor (AA, NA, etc.) and support phone numbers and verify it with the Court. Maintain regular contact with your sponsor and use your support numbers. Same as Phase 2.
Submit to medication reviews as directed. You will provide all prescribed medications, in their original containers, for review as directed. Same as Phase 1. Same as Phase 2.
Comply with a daily curfew of 10:00 p.m. - 6:00 a.m. and allow home checks by law enforcement to verify your compliance. Comply with a daily curfew of 12:00 a.m. - 6:00 a.m. and allow home checks by law enforcement to verify your compliance.  No curfew.
Secure employment or actively seek employment as directed and verify it with the Court. If you are already employed, then you must maintain your employment. You must complete community service or a GED program if ordered by the Court. Same as Phase 1. Same as Phase 2.
Make consistent payments on your Court ordered costs and fines. Same as Phase 1. All costs and fines must be paid in full in order to graduate from Sobriety Court.
You are not allowed to miss or be late for any of the above listed requirements without the advanced permission of the Court.  Same as Phase 1.  Same as Phase 2. 
You must not have ANY positive drug/alcohol screens for the last two months of the phase, and you must have the recommendation of the Sobriety Court Team to be considered for promotion to the next phase. You must not have ANY positive drug/alcohol screens for the last three months of this phase, and you must have the recommendation of the Sobriety Court Team to be considered for the promotion to the next phase. You must not have ANY positive drug/alcohol screens for the last four months of this phase, and you must have the recommendation of the Sobriety Court Team to be considered for graduation. 
Any unexcused violation of any phase requirement may result in your phase being extended or starting over. Same as Phase 1. Same as Phase 2.
