Affidavit of Decendents Successor

If the assets of the deceased do not exceed a certain value, an Affidavit of Decedent’s Successor may be filed with the financial institution. This does not require court involvement.

Assignment of Property

If a court order is required, a Petition and Order for Assignment may be filed with the court, if the assets of the deceased don’t exceed a specified amount after funeral and burial expenses. There is a $25.00 filing fee, an inventory fee based on the gross value of the property and the cost for a certified copy of the document is $10.00 for certification and $1.00 for each page of the document.
In addition to the Petition and Order for Assignment, a copy of the death certificate must be attached along with receipts for payment of the funeral bill. If the funeral bill has not been paid, the court will assign the assets up to the value of the funeral bill to the funeral home.

If the funeral bill has been paid, the court will assign the assets up to the funeral and burial expenses to the person who paid those expenses. If the deceased had a prepaid burial arrangement, the assets will be assigned in accordance with the law.

The amount that may be assigned after funeral and burial expense is adjusted each year by the cost of living. The amounts are updated annually by the State Treasurer.
