- You must call the assignment clerk for your assigned judge to obtain a pre-trial conference hearing date. The objection, notice of hearing and proof of serve must be filed within the 21 day period for objections to be filed. Failure to comply will result in dismissal of your objection.
- Objections must include a clear & concise statement of specific findings or application of law to which an objection is made. If the objection is to accuracy or completeness of referee recommendation, the inaccuracy or omission must be specified. MCR 3.215(E)(4). Failure to follow this requirement may result in dismissal of your objection.
- At the pre-trial conference, the court and parties will discuss considerations arising from MCR 3.215(F)(2), and whether a transcript of the referee hearing will be needed. Typically the transcript will be required and the objecting party will be responsible for obtaining the transcript at least 7 days before the de novo hearing. The court will consider the transcript as evidence submitted in the de novo hearing.
